Terms of Use – L-Parking Application

In case of any discrepancies between the Polish and English versions of these Terms of Use, the Polish version shall prevail. The English version is provided solely for convenience.

1. General Provisions

  1. These Terms of Use define the rules for using the L-Parking mobile application, available on Android and iOS devices.
  2. The owner of the application is Dariusz Curyło.
  3. The application allows users to share private parking spaces and reserve available spaces using the ParkCoin system.
  4. Using the application implies acceptance of these Terms of Use.

2. Definitions

Application – the L-Parking mobile application enabling sharing and reservation of parking spaces.

User – a person with an active account in the application.

Account – an individual user profile in the application.

ParkCoin – a virtual currency used to make reservations and earned by sharing your own parking spaces.

Location – a residential or commercial area (e.g., housing estate, building, gated community) where users share and reserve parking spaces in the application.

Parking Space – a physical parking spot shared in the application at a specific location.

Location Code – a verification code required for some locations.

3. Rules of Using the Application

  1. A mobile device with internet access is required for proper use of the application.

4. Registration and User Account

  1. Registration is completed by providing an email address and confirming the account.
  2. Providing a valid mobile phone number is required to use the application. The phone number is displayed to other users within the same Location and is used solely for contact related to parking reservations and resolving parking space access issues.
  3. Some Locations may require additional identity confirmation through SMS verification. Whether SMS verification is required depends on the settings chosen by the Location administrator or owners. In Locations using premium subscription features, SMS verification may be mandatory for all members to ensure the authenticity of users.
  4. The user is responsible for the security of their account.
  5. Users must keep their login credentials confidential. In case of suspected unauthorized access, users should immediately contact the application administrator.
  6. Users have the right to delete their account via the “User Data” section by clicking the “Delete Account” button. The deletion request will be processed within 30 days unless canceled by the user during that period.
  7. Account deletion is not possible if the user has a negative ParkCoin balance. In such case, the account can only be deleted after the balance is settled.

5. Rights and Responsibilities of the User and App Owner

  5. Violations may result in additional sanctions: temporary account suspension, restriction of app features, ParkCoin deductions, or ParkCoin balance reset.
  6. Users must respect common property and comply with rules at each location, including regulations set by property administrators. Littering, blocking driveways, or other disruptive actions are prohibited.

6. Payments and Fees

  1. Virtual Currency Nature
    1. ParkCoins are used to make reservations in the app, which is the primary function of the application.
    2. ParkCoins can be obtained by sharing your own parking space or purchasing through distribution platforms (e.g., App Store, Google Play).
    3. Purchases are processed via distribution platforms, which handle payments on behalf of the app provider.
    4. ParkCoins have no monetary value outside the application and cannot be exchanged for cash, goods, or services outside the app.
  2. Digital Content Purchase
    1. Purchasing ParkCoins constitutes the purchase of digital content under EU Directive 2019/770.
    2. Delivery occurs immediately after purchase or crediting coins for sharing a spot, starting the provision before the withdrawal period expires.
    3. By acquiring ParkCoins, the user consents to immediate service provision and acknowledges loss of the right to withdraw once the content is delivered.
  3. Specific Rules for ParkCoins
    1. If a reservation is canceled less than 12 hours before its start, only ParkCoins for the period after those 12 hours will be refunded.
    2. If the user changes the account location, all ParkCoins are reset; the user accepts the loss of previously earned coins.
    3. The app owner reserves the right to modify rules for earning and using ParkCoins and other app features. Users are notified via the app.
  4. No Refunds
    1. Purchased or earned ParkCoins are non-refundable.
    2. This applies even if ParkCoins have been partially or fully used in the app.
  5. Refunds by Platform Operators (Apple / Google)
    1. In exceptional cases, platform operators may issue refunds according to their rules.
    2. The app may:
      1. deduct ParkCoins from the user account,
      2. suspend the account in case of abuse or repeated refunds,
      3. block further purchases.
    3. Refund decisions are made solely by the platform operator and cannot be disputed with the app provider.
  6. Complaints
    1. Issues with the app or ParkCoin crediting can be reported via Contact.
    2. Complaints are handled within 14 days of receipt.
    3. Payment disputes should be addressed directly with the platform operator (Apple App Store / Google Play).
  7. Transaction History & Security
    1. All ParkCoin transactions are logged on the server to ensure security and allow verification.
    2. The administrator may review transaction history in case of complaints, refund requests, or suspected abuse.
  8. Final Payment Provisions
    1. Users accept that all in-app purchases are subject to the platform’s terms where the purchase was made.
    2. By purchasing, the user confirms they have read these Terms of Use and the platform’s terms.

7. Reporting Reservation Issues

  1. If a reserved parking spot is unavailable at the scheduled time (occupied by another vehicle or otherwise inaccessible), the user can report it via the app.
  2. Reports are reviewed individually. Confirmed reports result in ParkCoin refunds.
  3. Users are encouraged to contact the parking spot owner first. Contact details are in the reservation information.

8. Personal Data Protection & Privacy

  1. Details about personal data are available in the Privacy Policy.
  2. The app collects data such as email, phone, locations, parking space information, and reservation history.
  3. Users can access, edit, or delete their personal data.

9. Copyright & Intellectual Property

  1. All rights to the application and content belong to the owner.
  2. Copying or modifying the application without consent is prohibited.

10. Liability & Limitation of Liability

  1. The owner is not liable for user actions or errors from improper app use.
  2. Access may be temporarily limited for technical or maintenance reasons.
  3. Temporary unavailability due to maintenance, updates, or technical failures does not constitute grounds for claims.

11. Complaints & Dispute Resolution

  1. Complaints can be submitted via email: Contact.
  2. Disputes are resolved by the court competent for the owner’s registered address.

12. Changes to the Terms

  1. The owner reserves the right to modify these Terms of Use.
  2. Users will be informed of changes via the app.
